AN ORDINANCE REPEALING AND REPLACING IN ITS ENTIRETY ARTICLE XXIII, XXIV, and XXV OF THE ZONING ORDINANCES OF THE BOROUGH OF RIVERTON TO ADDRESS THE REQUIREMENTS OF THE FAIR HOUSING ACT (FHA) AND THE UNIFORM HOUSING AFFORDABILITY CONTROLS (UHAC) REGARDING COMPLIANCE WITH THE BOROUGH’S AFFORDABLE HOUSING OBLIGATIONS
PUBLIC NOTICE is hereby given that the foregoing Ordinance was introduced on the first reading by the Borough Council of the Borough of Riverton held on February 18, 2026
This Ordinance will be considered for final adoption after a public hearing to be held on March 4, 2026, at 6:30 pm prevailing time at the Riverton Borough Hall located at 505A Howard Street, Riverton, NJ 08077.

EXPLANATORY STATEMENT
Affordable Housing Ordinance, Borough of Riverton** Ordinance O‑2026‑06 repeals and replaces Articles XXIII, XXIV, and XXV of Chapter 128 of the Borough Code to fully update Riverton’s affordable housing regulations in compliance with the Fair Housing Act, the 2024 amendments to State housing law (P.L. 2024, c.2), Uniform Housing Affordability Controls (UHAC), and the Borough’s Court‑approved Fourth Round Housing Element and Fair Share Plan. The ordinance establishes comprehensive standards governing the creation, administration, and long‑term affordability of very‑low, low‑, and moderate‑income housing units. Key provisions include: municipal‑wide inclusionary set‑aside requirements; rules for new affordable housing development, rehabilitation programs, and supportive/age‑restricted housing; affordability controls and enforcement mechanisms for both ownership and rental units; monitoring and reporting requirements; and designation of municipal administrative responsibilities. The ordinance also updates the Borough’s development fee regulations, including collection, escrow, permitted uses, and Affordable Housing Trust Fund administration, to ensure fees are used solely for implementing the Fair Share Plan. These changes align Riverton’s zoning and administrative practices with current State law and court standards, ensuring continued compliance and protection against exclusionary zoning litigation.
