 SPECIAL MEETING NOTICE

 

PUBLIC NOTICE is hereby given that the Borough Council of the Borough of Riverton will hold a special meeting on Thursday, September 5, 2019 at 7 o’clock p.m. held at the Riverton School, 600 Fifth Street in Riverton N. J.   The purpose of this meeting is consider a second reading and public hearing of Ordinance 06-2019 and Ordinance 07-2019.

Additional business is to refer the Planning Board to conduct a consistency review of the same Ordinance for the Master Plan Housing Element

BOROUGH OF RIVERTON  Ordinance No. 2019-06

 AN ORDINANCE OF THE BOROUGH OF RIVERTON, BURLINGTON COUNTY, AMENDING CHAPTER 128 (“ZONING”), ARTICLE XA (“AFFORDABLE HOUSING AH DISTRICT”), ARTICLE X (“PARKS P DISTRICT”), ARTICLE IX (“NEIGHBORHOOD BUSINESS NB DISTRICT”), ARTICLE XB (“OVERLAY ZONES”), ARTICLE XXIV (“BOROUGH WIDE MANDATORY AFFORDABLE HOUSING SET-ASIDE”) AND ARTICLE XXV (“AFFORDABLE HOUSING DEVELOPMENT FEES”), OF THE BOROUGH CODE OF RIVERTON TO ADDRESS THE REQUIREMENTS OF THE SUPERIOR COURT OF NEW JERSEY REGARDING COMPLIANCE WITH THE BOROUGH’S FAIR SHARE AFFORDABLE HOUSING OBLIGATIONS

INCLUSIONARY ORDINANCE:  An Ordinance to amend the Zoning Ordinance, Chapter 128, of the Borough Code, Articles IX (Neighborhood Business District), X (Parks District), XA (Affordable Housing District), XB (Overlay Zones), XXIV (Borough Wide Mandatory Affordable Housing Set-Aside) and XXV (Affordable Housing Development Fees).  This Ordinance is to satisfy certain conditions of the April 29, 2019 Order of Fairness and Compliance of the Superior Court of the State of New Jersey in the Mount Laurel Declaratory Judgment Action entitled In the Matter of the Application of the Borough of Riverton, a Municipal Corporation of the State of New Jersey, Docket No. BUR-L-1621-15.

This Ordinance is to address the requirements of the Superior Court regarding the Borough’s compliance with its Fair Share Affordable Housing Obligations and to implement the Borough’s affordable housing plan.  This Ordinance establishes standards for affordable housing in the Martha’s Lane, Golf Course, Lippincott, Broad Street, Baptist Home and Affordable Housing Overlay Zones; requires an affordable housing set-aside of twenty percent (20%) for any new residential development of six (6) or more units; and establishes the standards for the collection, maintenance and expenditure of development fees collected by the Borough to be used for the sole purpose of providing low- and moderate-income housing.

 AN ORDINANCE OF THE BOROUGH OF RIVERTON, BURLINGTON COUNTY, REPEALING AND REPLACING ARTICLE XXIII “AFFORDABLE HOUSING REGULATIONS” OF CHAPTER 128 ZONING OF THE BOROUGH CODE TO ADDRESS THE REQUIREMENTS OF THE SUPERIOR COURT OF NEW JERSEY REGARDING COMPLIANCE WITH THE BOROUGH’S FAIR SHARE AFFORDABLE HOUSING OBLIGATIONS

FAIR SHARE ORDINANCE:          An Ordinance to repeal and replace the Borough’s current Affordable Housing Regulations, Chapter 128, Article XXIII, of the Borough Code.  This Ordinance is to satisfy certain conditions of the April 29, 2019 Order of Fairness and Compliance of the Superior Court of the State of New Jersey in the Mount Laurel Declaratory Judgment Action entitled In the Matter of the Application of the Borough of Riverton, a Municipal Corporation of the State of New Jersey, Docket No. BUR-L-1621-15.

This Ordinance is to address the requirements of the Superior Court regarding the Borough’s compliance with its Fair Share Affordable Housing Obligations.  This Ordinance establishes the administrative procedures and requirements, including, but not limited to monitoring and reporting, phasing, occupancy, price restrictions and income eligibility, to implement the Borough’s affordable housing plan.
